In general, you are Driving Under the Influence (DUI) in Alabama if your Blood Alcohol Content (BAC) is 08% or higher OR you are incapable of driving.  DUI applies to both alcohol or drugs, even prescription drugs.  However, different rules apply if you are under 21, a Day Care or School Bus driver or a commercial vehicle driver. For these reasons, it is very important to seek the council of an attorney if you have been charged with a DUI.
